very n00b question .. but don't the new patches get downloaded automatically? and installed automatically? is there any way to check this? or check the version of your game?

when you launch the game on the front page there is a version number in the lower right/left (can't remember) conner IIRC. you cannot play the game unless you are up to date, so if you are playing the game now then you are up to date.

The game will start downloading any new patches when you log in, then it closes wow and runs the blizzard downloader program (automatically). Once thats done it will install it and you can play.

You cannot play on the blizzard realms (ie the only legal and properly working ones) without the latest patch so it's nothing you need to worry about.
